"The character encoding of the document was not explicit (assumed utf-8) but the document contains non-ASCII."

Consider <!doctype html><!-- â€œ --><meta charset=utf-8>... (http://validator.nu/?doc=http%3A%2F%2Fdev.w3.org%2Fhtml5%2Fpubnotes%2F&showsource=yes )

The message would be more accurate if it said that no explicit character encoding declaration has been seen yet but non-ASCII was found, or something along those lines.
